Announcement of the Receipt of Complaint
SOFTBANK CORP. (“SOFTBANK”) and its wholly owned subsidiary, JAPAN TELECOM CO., LTD. (“JAPAN TELECOM”), announced today that on December 16, 2004, the two companies received a petition for a provisional injunction and a complaint, both dated November 29, 2004, from HEISEI DENDEN CO., LTD. (headquarters: Shibuya-ku, Tokyo; Representative: Kenji Sato; “Complainant”).
The Complainant demands that SOFTBANK cease disclosing confidential information about the Complainant’s services to JAPAN TELECOM. The Complainant claims that SOFTBANK obtained the information through capital tie-up negotiations held last spring between the Complainant and SOFTBANK and in other opportunities, and that SOFTBANK disclosed the information to JAPAN TELECOM.
Furthermore, the Complainant demands that JAPAN TELECOM cease providing the direct-collection-type fixed-line telephone service called Otoku Line. The Complainant claims JAPAN TELECOM developed the service using confidential information obtained from SOFTBANK and others.
We hereby affirm that there are no facts that substantiate the disclosure or use of the information as claimed by the Complainant.
